If there is a presence of asbestos in a rental property, as a landlord you should be familiar with your health and safety responsibilities including how to manage asbestos at your rental property. For example, Rule 1206, adopted by The San Diego County Air Pollution Control District, is applicable to all rental owners. Legally, landlords do not have an obligation to remove asbestos from a rental property. However, landlords must provide a habitable premises. Landlords have certain duties towards their tenants to minimize the risk of exposure. As an example, if contractors are doing repairs, or renovations, as this could disturb material that contains asbestos.

Asbestos Removal, Renovation, and Demolition
Asbestos was a common building material up until the 80s. But, just because asbestos is present in a rental property does not mean you will need to remove it. As long as the asbestos has no danger of becoming airborne, there is no reason to remove it. There are certain requirements that are enforced under the federal Occupational Safety and Health Administration (OSHA) designed to protect people. And, there are other rules and regulations such as Rule 1206 adopted by the San Diego Air Pollution Control District. San Diego’s Air Pollution Control District (APCD) has begun to strictly enforce Rule 1206: new construction standards for asbestos testing to renovation or demolition projects.
